Maybe Alan refers to the webstream loophole?

Ofcom have no jurisdiction over your webstream - so if you sell advertising
on stream and website then there are (small) revenue opportunities.

Of course if the FM transmitter relays the same audio as the webstream then
there will be a degree of "free" advertising provided on the FM waveband....
