Please find below details of the ATVOD consultation on video on demand.

 Dear Stakeholder,

 We have today published a consultation on a proposal to adopt new guidance
on the scope of the regulations that apply to video on demand services.

 Since April 2010, ATVOD has published guidance (“Guidance on who needs to
notify”) as to the factors and criteria that are applied by ATVOD when
determining whether a service falls within the definition of an ‘on-demand
programme service’ (“ODPS”) under section 368A of the Communications Act
2003 and is therefore subject to the regulatory framework for VOD. In light
of its experience since 2010, ATVOD considers that it is now appropriate to
adopt revised guidance, and has developed new draft guidance (“the Proposed
Guidance”) in consultation with the ATVOD Industry Forum and Ofcom.

The consultation document sets out  the Proposed Guidance and seeks
stakeholders views. Full details can be found at:

Respondents are requested to use the response sheet published with the
Consultation Document.

Consultation published: 17th September 2013.

Consultation closes: 5pm on 17th December 2013.

Responses will be published on the ATVOD website.

We are working towards publishing a statement on the proposed guidance in
January 2014.
