Don't bring PRS into the debate :-) they're another joke outfit who move
goalposts around to suit there own means. We are sick to death of goalposts
being shuffled about. It is on-air or it is off-air ... under this debate it
can't be both. Of course things are related to broadcasting
we're a bloody radio station ! (lol playing devils advocate of
course)

To be clear .... In black and white and in the 'contract' no cash,
no money, no barters, no nothing if there are any of these they
are for the OFF-AIR activities and advertising.

Of course and as I have already mentioned the money goes to buy equipment,
pay for licenses etc which are directly / indirectly related to broadcasting
as well as training and other things. We are a radio station, not a bus
company or a hairdressers.

The arguments are tired, we are fed up with bureaucracy and we are fed up
with the rules which in themselves are illegal.

116,000 250,000 1 Million it doesn't matter, it is irrelevant
and should never have been passed. If there are only 10 listeners, then yes
I admit, that makes things difficult for the Commercial boys . however, it
also makes things difficult for us. It is all relative.

You are aware that this is discrimination. It is discrimination in relation
to geographical area. Geographical area could be translated into other ways.

Thanks for your support and interest as always.

Nick

I'm all for getting round silly rules creatively, but note that off-air
advertsiing that can be shown to be linked to broadcasting activities is
potentially counted by the copyright bodies as 'broadcast revenue', and they
can try to count the nominal value of ads given free. I guess Ofcom may not
count it exactly the same way however.

PRSforMusic's definition is "advertising sponsorship, subscriptions,
donations, barter and contra deals, and other revenue directly related to
the programmes broadcast."

I guess the key is in the determination of the phrase "directly related".

Dear All

Just a quick addition to my e-mail (yesterday) in order that there is no
confusion ...... the rules state ''no PAID on-air advertising'' .. You will
be aware that we don't agree with this, never have and never will .I
personally have been quite forthright and aggressive in my views on this,
and that will not change.. however, what we can do is completely 'by-pass
it' our view is now quite simple:- if people wish to behave in a
silly manner then we'll do the same. Let's all be silly seems to be the
order of the day :-)

We will run adverts for people, and as of November we will GIVE THEM AWAY
FREE ! (ready for Chrimbo) I actually think we should be commended
for this especially when only this morning we have more bad news for
businesses, the economy and the unemployed.

Because of the nonsense there may be another 5 part-time workers (from here)
joining the already two and a half million OR we can all be
sensible, positive and pro-active and actually create a few more jobs and
even give some nice little tickles for young people (of whom we have plenty)
as they are the ones getting the brunt of the current climate.

In a Court of Law, we will be able to prove our 'contract' with our
supporters / sponsors it will be the same as the contracts
that we have had since 2005 and they have not changed. They are in black and
white and I have enclosed a copy. The best Solicitor in the world would not
be able to make the rules seem tweaked .. as they have not been. Our
advertising tariffs 'off-air' remain exactly the same.

All on-air activity is NOT included as there are no agreements on this .....
This will be at our discretion.

This is not even a Bog-off deal .... The contract does not state
buy-one-get-one-free we will give it away free if we so desire.
The downside of this of course is that our fundraisers have to be able to
convince the potential sponsor that the existing deal (not ideal) is good
enough. We believe/know it is, as do many of our current supporters. If we
decide to give things away 'no strings attached' it will be Christmas
come early.
