This is another situation where the legislation is out of step with
technological advance.

We know that know that PPL are currently developing a licence that, I
understand, will cover podcasts containing music clips of 30 seconds
maximum duration but they do not have the podcast licence finalised as
yet.

The MCPS-PRS Alliance has developed a Joint Podcast Licence to cover
the use of music within a podcast.

The fees for 2008 are as follows - broadcasters will need to pay which
ever is highest.

Headline Royalty Rate   8% of Gross Revenue
Per Track Minimum       0.15p (excludes VAT)

The podcast licence carries a minimum quarterly fee of £50 per quarter
(excluding VAT).

However, *limited* podcast services, which are perhaps more relevant to
the community sector, are covered by the Limited Online Exploitation
Licence (LOEL):

The tariffs, subject to VAT, are as follows:

<68,000 downloaded works per annum - £120

<136,000 downloaded works per annum - £240

<340,000 downloaded works per annum - £600

The CMA is in close contact with PPL and we will update this list with
details of their podcast licence as soon as it is finalised.
