My complaint is that I believe the rate is set too high for the smallest stations, and the application of excessive minimum fees makes the effective rate even higher for the smallest stations. This situation has been allowed to arise largely because of the monopolistic position of our collecting societies, and the lack of effective provisions to protect small-scale music users.<o:p></o:p></span></p><p class=MsoNormal><span style='font-size:11.0pt;font-family:"Calibri",sans-serif;color:#1F497D;mso-fareast-language:EN-US'><o:p> </o:p></span></p><p class=MsoNormal><span style='font-size:11.0pt;font-family:"Calibri",sans-serif;color:#1F497D;mso-fareast-language:EN-US'>If there were a level playing field or effective market mechanism for negotiating these rates things might be different, but there is no realistic negotiating mechanism open to the smallest players in the field (the not-for-profit, socially-motivated sector). <o:p></o:p></span></p><p class=MsoNormal><span style='font-size:11.0pt;font-family:"Calibri",sans-serif;color:#1F497D;mso-fareast-language:EN-US'><o:p> </o:p></span></p><p class=MsoNormal><span style='font-size:11.0pt;font-family:"Calibri",sans-serif;color:#1F497D;mso-fareast-language:EN-US'>I note in the US the model for non-profit stations seems much fairer. The US has imposed consent decrees on the two biggest collecting societies to push them to compete for licences and offer them fair terms. One of the two main US copyright bodies, ASCAP, offers a simple licence for low power stations that provides flat fees based on station wattage. The licence fee for 50W stations is $232, with no percentage royalties. So a broadly equivalent US body would charge most stations in our community sector about a sixth of PRSfM’s current <i>minimum</i> fee!<o:p></o:p></span></p><p class=MsoNormal><span style='font-size:11.0pt;font-family:"Calibri",sans-serif;color:#1F497D;mso-fareast-language:EN-US'><o:p> </o:p></span></p><p class=MsoNormal><span style='font-size:11.0pt;font-family:"Calibri",sans-serif;color:#1F497D;mso-fareast-language:EN-US'>For non-profit stations over 100W, such as the one I look after, ASCAP fees are based on the station’s population count, programming format and the level of use of music. The stations are not required to sign an agreement and the rates are set by a federal Copyright Royalty Board.
