</head><body><p>Given it's only one, or possibly two, annual returns for each body, I have never found it a hassle to deal with both bodies (or three to include about £5 annually to MCPS back 10-13 years ago). There will still be two bodies with two separate sets of policies and charging regimes, so maybe yes it's a positive step, but it's a small step and mostly window dressing, with no impact on the underlying rates. </p><p>The modest work of signing an agreement, making an annual return of NBR, and setting up an annual or quarterly bank payment was never the problem with the system for me - it is the practice of applying large minimum fees and the same percentage scales as stations of many times our income that I object to.</p><p>Bear in mind, the Copyright Tribunal never agreed to PPL or PRS levying any kind of minimum fee (which can raise the effective royalty rate to 10% or more for a small station), and has in the past explicitly expressed opposition to any kind of premium payments - ie payments purely for having an agreement.</p><p>At the time of the 1993 settlement on which most of this was based saw the tribunal decide that in view of their more difficult profitability, there should be a progressive scale for smaller stations, with in the case of PPL a reduced band to 3% for a middle tier, and 2% for the lowest tier. However, at that time the tribunal did not envisage the likelihood of anything like the kind of micro-market/non-profit operations as we have now, and it is quite reasonable to think that had they envisaged such a scene, they might have added, say, a 1% band for the very lowest level exploiters of the repertoires.</p><p>One also has to wonder why neither PPL nor PRS has ever applied for a statutorily approved licensing scheme as provided for under the Copyright Act, but never used by them. They prefer to use a cartel system with exclusive contracts between themselves and the original rights holders locking anyone else out of the market, and allowing them to impose licence terms unilaterally.</p><p>Re <em>"Technically if I wanted to play my 7” single at a party in a church hall (therefore in public) I would be infringing my granted rights. When making a comparison to the 1970’s and 1980’s - he majority of the modern world, which had single or a joint body. The UK had THREE bodies, all dealing with separate elements of the recording and intellectual property.</p><p class="ox-7eac39e9e1-MsoNormal"> </p><p class="ox-7eac39e9e1-MsoNormal">At that time comparisons were regularly made about the systems in North America and some European Countries. These territories operated a much more integrated system of Rights Collecting (PRS), Phonographic Performance  (PPL).</p><p class="ox-7eac39e9e1-MsoNormal"> </p><p class="ox-7eac39e9e1-MsoNormal">I suppose we were very much wedded to a 100 year old system that had grown up from Sheet Music and the Cylinder Wax recording. In fact the third body was the Mechanical Copyright Society. They I believe, had their origins in the paper piano rolls from the turn of the last century.</p><p class="ox-7eac39e9e1-MsoNormal"> </p><p class="ox-7eac39e9e1-MsoNormal">I believe this was more or less the case but feel free to correct me, that when you purchased a vinyl record you only owned the <u class="">unprinted</u> platter. MCPS owned the groove; PPL owned the recording and PRS managed the actual Intellectual Rights of the song and its composer/s.  From the cost of the 7/6d  7” single, money was apportioned to each body to grant a licence to the owner of the record.</p><p class="ox-7eac39e9e1-MsoNormal"> </p><p class="ox-7eac39e9e1-MsoNormal">Technically if I wanted to play my 7” single at a party in a church hall (therefore in public) I would be infringing my granted rights. Similarly if I wanted to play it on my radio station I would have to seek further rights to broadcast it.</p><p class="ox-7eac39e9e1-MsoNormal"> </p><p class="ox-7eac39e9e1-MsoNormal">At the time when ILR started, radio stations were dealing with at least two data sets. PRS would require a one format and PPL another. These would have been typed sheets for every piece of repatoir . It is not the actual contract. The agreement is probably offered to all and therefore PPL/PRS cannot alter the agreement to favour a particular licensee.
