Correct James, the person providing the service is the ‘legal person’ – usually the company that holds the licence, in effect ‘the station itself’ – so you can’t say “Smalltown FM supports the campaign to keep the swimming pool open”, and you can’t run any promotional messages for the campaign as such, but within significant limits an individual presenter can say they he/she supports it. On the whole though it is safer to avoid even that I think (depending on the scale/importance of the item in question of course).

 

However, even then the rules require that presenters do not use their position to give ‘undue prominence’ to their own opinions, and it must be made clear that it is just their personal opinion.

 

People reading the news may not express opinions, and during election periods such things are strictly off limits for all presenters.

A definition of "person providing the service" is probably useful here. It isn't the presenter, as I understand it. You have much more freedom than you'd think you do.

 

You're best to consult with someone like Paul Chantler or Daniel Owen.

I have heard a community station do exactly that a year or so ago regarding a library.

I've looked for a specific rule about not influencing statutory bodies in the codes, but can't seem to find it.

If you or someone could point me to the approporate paragraph, I'd appreciate that.

It can be political when it concerns its own future.

 

Under the Broadcasting Act and Ofcom codes, radio stations are not permitted to be politically partial or to engage in activities intended to influence the decisions of statutory bodies (eg it’s illegal for a radio station to support a campaign against the closure of a local hospital or library) *BUT* there is one exception in law, and that is when the decisions could have a direct effect on the activities or future prospects of the radio station.
